The Illusion of Communication

(Originally posted at Absolution Mediation)

Take a moment to read this quote,

"The single biggest problem in communication is the illusion that it has taken place." - George Bernard Shaw
This is a problem that I think we have all had at one time or another.

Reducing poverty or new breed of eugenics? Sterilization in Rwanda.

[originally posted at http://apeaceofconflict.com]

A recent announcement calling for vasectomies (sterilization) of 700,000 males over the next two years by Rwandan authorities has many fearing a new eugenic depopulation attempt in Rwanda. The…

Politicizing the holidays. Maouloud in Côte d’Ivoire.

Today in Côte d’Ivoire there is public holiday; at least for some. Others will take the holiday tomorrow.

Sadly, the holiday to commemorate the birth of the Prophet (peace be upon him), known as Maouloud/Mawlid (and numerous other spellings), is now being used as a political weapon between Gbagbo and Ouattara’s camps. On Monday, Imam Idriss Kudu Kone, chairman of the National Islamic Council (CNI), declared Tuesday the paid holiday, which was supported by the Gbagbo government.…

Do you want to be a driver or a passenger?

(Originally posted at Absolution Mediation)

I drive everyday.  I love it.  I drive to work, friends house’s, long trips, you name it, I drive there.  So whenever I become a passenger in a vehicle, I feel a little strange.  It’s like someone else is controlling my fate, and taking me towards my destiny.

Dramatic?

Probably.  This is one of the things that… Continue

Fairly Legal - Mediation Truth or Fiction?

A hotly debated topic in the dispute resolution field is the new television series on USA Network "Fairly Legal". The show's entertaining focus is on a female, attorney mediator, Kate Reed and her alternative approach to dealing with conflict unlike her aggressive, litigious and now deceased, attorney father. For the dispute resolution field, this is an awesome opportunity to educate…

Discipline: Are you Focused on your 95%?

Originally posted at www.thebusinessmediator.blogspot.com

I was shocked recently as I read a blog entry on change by Tony Schwartz on the Harvard Business Review Online.  In it, he states that 95% of our behaviors are habitual, and only 5% are consciously self-selected.   How can this be?  Are we so programmed that we literally only choose to do things 5% of the time?  This hit home for me in particular, since I believe so…

Mediation Process Leaves Homeowners & Lenders Unhappy

With all the hoopla around how mediation is so grand, I thought this would be a good reality check since my blog is 'fair and balanced'. (Anyone laugh at that? Anyone??)

The Nevada Supreme Court, which oversees the Foreclosure Mediation Program, has several times in the past 18 months updated program rules in response to concerns that have arisen, but bank officials and homeowners say the program still has problems that must be addressed.

...Homeowners said the program… Continue

Sometimes the Amygdala rules

Recently, I seem to have forgotten all that I learned in ADR with my fine Creighton education.  In three different situations in two days, I ignored all that I learned and reverted to my Brooklyn wise guy ways.  In the first real world case study, I intended to fill my gas tank in anticipation of the impending blizzard at my local station in my hometown of Plymouth, Michigan.  An SUV was left unattended for over 15 minutes at one of the pumps.  I was directly behind the…

ODR Blog: ODR, by any other name… Join the hunt?

Out there in cyberspace, Online Dispute Resolution is being developed and practiced by people who have never attended Cyberweek, participated in the International Forum on ODR, or even heard of the term ODR. Their development of the tools and practices of ODR is at least as important as the development work being conducted by the dispute resolution world. ODRBlog is going to hunt these platforms and practitioners down and introduce them to the ODR…
