The European Commission publish a Directive on Consumer ADR and a Regulation on Consumer ODR

The European Commission has published two important legislative proposals:

(i) Directive on Consumer ADR establishing minimum standards for ADR schemes and requiring EU Member States the provision of ADR services for resolving B2C disputes. 

(ii) Regulation on Consumer ODR establishing an a pan-European ODR Platform that will coordinate ADR schemes and become a single point of entrance for resolving online (cross-border) B2C disputes.

You’d think I’d be over getting amazed at how real, intense and engrossing online interactions can be. After all – after years of mediating online, and teaching online, designing online processes and writing about relational effects and negotiation aspects of online interaction, I should really internalize the power of the online and the ability of skilled people to humanize it.

Michigan County Court Launches Pilot Ombuds Program for Bench and Bar

The Oakland County Circuit Court has appointed an Ombudsman to serve as a liaison between the judiciary and local attorneys for a six month trial period. Joel H. Serlin, an attorney with "a stellar reputation as a lawyer, mediator and arbitrator" will serve as the Ombuds. He will seek to address and facilitate issues and concerns raised by attorneys regarding active matters before the court.
